Rim Reader: Terms of Use and Safety

Key points. Rim Reader gives estimates that can be wrong. You make adjustments and drive at your own risk. Have a qualified shop check your alignment. As far as Tennessee law allows, you give up claims against us, including claims for our negligence, and our liability is limited. The full terms below control.

Rim Reader is provided by Middle TN Auto Repair LLC, a Tennessee limited liability company ("we," "us," "our"). These terms are a contract between you and us. You must be 18 or older to use Rim Reader. By ticking the box and tapping Accept, you agree to them. If you do not agree, tap Decline and do not use Rim Reader. If you paid for Rim Reader and do not agree, you may ask for a refund through Google Play or through the developer contact on Rim Reader's Google Play listing. Using Rim Reader is optional; professional alignment shops are an alternative.

1. What Rim Reader is. Rim Reader is a do-it-yourself measuring aid. It estimates wheel alignment angles from your phone's sensors and a bracket held against the wheel. Its readings can be wrong because of the phone, the bracket or how it was printed, where and how it is placed, the floor, the vehicle, or errors in the app. It is not professional alignment equipment, and it does not check whether the steering, suspension or tires are safe. In these terms, "Rim Reader" means the app, the bracket design, and all readings, instructions and reports, including pictures and files you save or share.

2. Safety rules. Work on firm, level ground with the engine off, the parking brake on and the wheels chocked. Never get under, or reach under, a vehicle held up only by a jack; use rated jack stands. Before adjusting, inspect the tie-rod ends, ball joints, bushings and tires, and do not adjust or reuse worn, bent or damaged parts. Follow the vehicle maker's procedure and specifications. Tighten jam nuts, lug nuts and other fasteners to the maker's torque. Center the steering wheel and check that the steering moves freely from lock to lock. Remove the phone and the bracket before moving the vehicle. Never use the app while driving. Make your first test drive slowly, in a safe, empty area; if the vehicle pulls, wanders, vibrates or makes noise, stop and have it inspected. Have a qualified shop check the alignment before highway driving or carrying heavy loads.

3. The bracket. The bracket is printed by you or by others. We do not make it and do not control its quality. Inspect it before each use, and do not use it if it is cracked, loose or worn.

4. Reports and other people's vehicles. Reports are estimates. Do not present them as a professional or certified alignment. If you use Rim Reader on a vehicle you do not own, you alone are responsible to its owner and occupants, and you must tell the owner that the results are estimates.

5. Business users. If you use Rim Reader in a business (including on the Mobile Mechanic or Shop plans), you agree to defend, indemnify and hold harmless Middle TN Auto Repair LLC and its members, managers, employees and agents from all claims, losses and costs (including reasonable attorney fees) arising from your work, your use of Rim Reader or your breach of these terms, INCLUDING CLAIMS ALLEGING OUR NEGLIGENCE. This does not cover our gross negligence or intentional misconduct.

6. NO WARRANTIES. RIM READER IS PROVIDED "AS IS," "WITH ALL FAULTS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT ITS READINGS ARE ACCURATE OR THAT IT WORKS WITH YOUR PHONE OR YOUR VEHICLE.

7. ASSUMPTION OF RISK AND RELEASE, INCLUDING OUR NEGLIGENCE. ADJUSTING WHEEL ALIGNMENT AND DRIVING AFTERWARD CAN LEAD TO CRASHES, INJURY, DEATH, AND DAMAGE TO VEHICLES, TIRES AND OTHER PROPERTY. YOU CHOOSE TO TAKE THESE RISKS. YOU RELEASE, AND AGREE NOT TO SUE, MIDDLE TN AUTO REPAIR LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS FOR ANY CLAIM ARISING FROM YOUR USE OF RIM READER, INCLUDING CLAIMS BASED ON OUR NEGLIGENCE (FOR EXAMPLE, AN ERROR IN THE APP'S CALCULATIONS OR INSTRUCTIONS). This release does not cover our gross negligence, our reckless or intentional misconduct, or anything the law does not allow to be released.

8. LIMITATION OF LIABILITY. IF WE ARE FOUND LIABLE DESPITE SECTION 7, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST INCOME, TIME OR PROFITS, AND OUR TOTAL LIABILITY FOR ALL CLAIMS IS THE GREATER OF (A) WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) US$100. This does not limit any liability the law does not allow to be limited.

9. Privacy. Rim Reader keeps your measurements, vehicles and settings on your phone, except as described below. We do not collect them, and the app sends nothing to us unless you send us feedback. If you use the shop features, the customer names and phone numbers, license plates and mileage you enter, and your shop's details and logo, also stay on your phone and print only on your shop's reports. When you share a result, it goes only where you send it. PDF reports you make are saved in your phone's shared Download/Rim Reader folder, where other apps with access to your files can read them; they stay there until you delete them, even if you uninstall the app. If your phone backs up its apps to your Google account, Android may include Rim Reader's data in that backup. On Android, Rim Reader includes Google's ML Kit for the VIN, tire-size and license plate scanner: the picture, the VIN, the tire size and the license plate are read on your phone and are not sent to Google, but ML Kit sends Google diagnostic and usage information about your phone and Rim Reader (such as an identifier for this installation of the app that is not meant to identify you or your phone, the phone's model and system version, the app's name and version, and how the scanner performed) and may download updates from Google. When you enter or scan a VIN, the app asks the U.S. National Highway Traffic Safety Administration's free vehicle database (vpic.nhtsa.dot.gov) for the vehicle's model and details. It sends only the first 11 characters of the VIN, with the 9th hidden, and the model year, never the last six characters (the serial number that identifies your vehicle). NHTSA sees your phone's internet address, as any website does, and NHTSA's own privacy policy applies. Without a connection, you choose the model yourself. When you send feedback from Settings, Send Feedback, the app sends us what it is about, your message, the email address you give, if any, and, unless you untick the box, the app's version, your phone's model and system version, whether yours is a shop account, the date of your bracket calibration and the bracket profile. The app never adds a VIN, a license plate, customer details, notes or readings, so please do not type them into your message. Feedback goes to a Google Form we own, so Google keeps it for us and sees your phone's internet address, and Google's privacy policy also applies; we use it only to answer you and to improve Rim Reader. 10. Changes. If we make a material change to these terms, the app will ask you to accept the new version before you use it again. A change does not apply to a dispute that arose before it. The version you accepted is shown in the app under Settings, About, Terms of Use and Safety, and past versions are available on request at info@rimreader.com.

11. Disputes. These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules. Any dispute will be decided in the state or federal courts for the county in Tennessee where Middle TN Auto Repair LLC has its principal office, except that either of us may bring a claim in small claims (general sessions) court where it qualifies.

12. General. These terms are the entire agreement between you and us about Rim Reader. Google Play's terms govern your purchase. If any part of these terms cannot be enforced, the rest still applies, and that part is enforced as far as the law allows. Sections 1 and 3 to 12 continue to apply after you stop using Rim Reader.
